OH NO I read Pokemons Terms of Use
“-5. User Rights and Restrictions, in no instance may you:
(ii) Modify, or create derived works based on”
THAT MEANS THEY CAN SHUT US DOWN! DON'T SEND THE EMAIL, THEN THEY KNOW!
But then isn't telling the truth better than not telling the truth?

Not asking at all is better for us than anything… What they don't know can't hurt them. But telling the truth is good but not when it risks something you've been working on since MARCH!OH NO I read Pokemons Terms of Use

Well, the closest you can get to not being shut down is by sending the email. If you don't they have a huge chance of closing it down if it gets featured or whatever of some sort I read Pokemons Terms of Use

You're right, but what if they take lying and not telling them earlier into consideration of shutting it down?Not asking at all is better for us than anything… What they don't know can't hurt them. Yes, but we have something going for us too: Creative Commons. This would legally be read as ‘it is illegal to modify source assets or use them without the company’s consent.' They can't shut us down if we use only our own content. Meaning we make everything, same as them, we aren't violating their TOU. I read Pokemons Terms of Use

However, if challenged by the owner of the copyright, you could probably claim that you were exercising your right to “fair use” given that this is an educational website and nobody is making any money here. We are modifying source assets to be fakemon, using the idea of pokemon. If they give us permission, we can use any content of theirs that they allow us to use + make fakemon if Nintendo agrees.)
btw, the company that owns pokemon is game freak (Nintendo holds a share but can't make major choices like copyright stuff since it probably doesn't hold more than 50% of the company

According to most sources, Nintendo only owns a 1/3 while 2 other companies own a 1/3 each in game freak*
